Patent New Invention
Patent New Invention: this is done for your protection
The reason you should patent new invention is to give yourself the maximum protection against any loss of revenue you are entitled to.
The first step before you even get the form to file a patent is to conduct a thorough patent search. There have been many patents granted that are meaningless if they infringe on another patent. It is the responsibility of the patent filer to know if they are infringing on another patent or not.
There are several different methods to conducting a patent search. The United States Patent and Trade Office always ask users to search by patent number, inventor’s name, or keywords that are used as part of the patent search.
Many experienced inventors actually do this research before they begin to work on a project. It does not make any financial sense to reinvent something that already exists. A patent search can reveal if there is a product like your idea already covered. Many times the search will discover similar items or inventions. If the search is done before the project has begun, all similarities can be removed beforehand to save time and make your invention unique.
What specific protection a US patent will offer an inventor is the right to exclude others from using, offering for sale, or actually selling your product, within the United States. The US patent will also stop anyone from importing the same or similar product from another country.
Currently, the fee for filing to patent new invention is $330.00 and, if applicable, there is a small entity fee of $165. There are many different classifications, so check with the USPTO website from proceeding.
